Their mistake, they should pay. Won't they be doing that? Small claims court sounds like a bigger pain in the ass. I think our systems are a bit different but when a company makes an error, charges are usually reversed.

So frustrating. Sorry this is happening!  

Is there a local TV news outlet "problem solver" person?  I think the publicity alone would solve it, and get the extra incurred costs (over draft fees) they have caused you.

A call to the courthouse should answer your question about small claims court.

Before small claims, have you pressured your bank to reverse the NSF fee? That is likely your first/best line of resolution right there. Have the name/number of the contact at the Billing office and suggest a conference call w the bank, you, billing to discuss/resolve (they will probably reverse the fees at that point...too much trouble).

If you never had the test, that's fraud and you could rightfully take 'em to criminal court if you wanted.  (I'm sure you know that, Jilly, but just wanted to state for clarity's sake. *smiles*)

Anytime I've had something like this happen, it's usually been a bank error and they have immediately and with apology refunded any NSF fees -- but I'm with a credit union.  I don't know about an actual "bank"-bank.

If it was the hospital's error, a call from them to the bank manager should set the record straight without too much hassle for you.

It's a credit union & they just refunded the NSF fees & were nice enough to tell me the hospital double-charged me 3 times LOL.

So glad they were already able to refund the NSF fees, Jilly.  Banks are usually good about that when it is the merchant's fault.  Is there anyway to dispute it with the credit union (and have them hash it out with the hospital?)  So annoying, I  hope this gets taken care of for you soon!

I talked to the hospital and it might be up to 4-6 wks before I get my $$ LOL.

Mars is on my Pluto right now so I thought it best to temporarily say "thanks I guess it's out of my control right now" LOL & get off the phone until tomorrow.

Absolutely - threaten them with the local press if you don't get all your incurred fees back pronto - they will hate that. Nothing like the threat of press exposure to get things moving... Do you know any local journalists? ;)  A well phrased phone call usually does the trick...! I have a tame one who wil always play ball for chums in such situations - and it usually works

I shamelessly use my handicap in these kinds of scenarios - it's such a pain and money-stifler, I feel it's only fair to use it to my advantage when I can ...

When you have a chronic illness, being a "patient" is a full time job. My mother helps me with some of the paperwork and sorting out the billing, and she always says, "How is a sick person supposed to handle this??"

Don't these hospitals understand how acutely stress affects the chronically ill? - how can such glitches happen?

(((Jilly)))  When this happened to us, in a round about way.  It sucks, hang in there!  I say you call them and tell them you want your money back today.  Not in 4wks you need it today or you'll sue for double/triple billing.  That sould escalate your account and get it back sooner (like within 5days).

THough the 478.50 bill says it's for an EMG it is not for an EMG, it's for something else. Waiting for an email to tell me what it is for LOL.

You're welcome Jilly.  The lady that I was working with told me to call them EVERYDAY and ALL DAY!!  I laughed and she was like "NO, SERIOUSLY, listen to me!!!!".  I didn't, in the end I called them 2X's and then next think you know, a refund check shows up.  I sure hope it works that way for you, too :)
